Following a referral from the public prosecutor in Nanterre, the Directorate General for Competition, Consumer Affairs, and Fraud Control (DGCCRF) conducted an investigation. Nintendo was found guilty of deceptive business practices for failing to alert consumers when technical issues were reported. The company did not issue a statement on the matter until 2020, even though the drift had been documented since 2018.

Thus, Nintendo of Europe will have to pay a €35 million fine as part of a criminal settlement. A statement will also be published on the homepage of Nintendo France’s official website.

In 2023, the manufacturer’s European branch had committed to repairing defective controllers free of charge, regardless of the warranty period.
